Evidence -- Testimony of Approver -- Corroboration in Material Particulars -- Rule of prudence, not a rule of law
Evidence Act, 1872, S.133 -- Testimony of Approver -- Corroboration in Material Particulars -- A conviction on uncorroborated accomplice testimony is permissible under S.133, but illustration (b) to S.114 of the Act cautions that such testimony is unworthy of credit unless corroborated in material particulars. Corroboration must come from independent sources, and testimony of one approver cannot corroborate another. It is not required that every material circumstance against the accused be independently confirmed. An approver's testimony cannot be discarded merely because he does not implicate himself to the same degree as the other accused, provided his account makes a full and truthful disclosure of the events surrounding the crime.
