Evidence Act, 1872, S.8 -- Identification of Accused -- Dock Identification Without Test Identification Parade -- Absence of a Test Identification Parade is not fatal to the prosecution's case where the witness had sufficient opportunity to observe the distinctive features of the accused at the time of the incident, or where the accused was arrested on the spot immediately after the crime. Dock identification in court for the first time cannot be discarded on this ground alone where the circumstances lend assurance to the testimony of the witness.
