Eviction --Tenant Acquiring Co-Ownership--Eviction Proceedings Cannot Be Continued Against Tenant Who Becomes Co-Owner of Suit Property
Eviction proceedings against a tenant cannot be continued once the tenant acquires ownership rights in the suit property, even to the extent of a share. Upon such acquisition, the tenant attains a dual capacity — that of owner and tenant — and the landlord cannot pursue eviction in respect of the same premises. Where one co-owner transfers his share to the tenant and expresses unwillingness to continue proceedings, eviction cannot be sustained. Subsequent events altering the status of parties have direct bearing on the entitlement of co-owners to seek eviction.
