Eviction -- Bona Fide Requirement -- Not Established Where Landlord Lets Out Alternate Property During Pendency of Eviction Petition
Under Section 14(1)(e) of the Delhi Rent Control Act, 1958, a landlord's claim of bona fide requirement for eviction fails where the landlord lets out a newly constructed alternate property to other tenants during the pendency of an earlier eviction petition and does not occupy existing vacant rooms in the same premises --Such conduct casts doubt on the genuineness of the claimed requirement, and landlords cannot rely on structural defects without invoking Section 14(1)(f) or (g) of the Act.
