Electricity--Pendency Of Civil Dispute Over Property Ownership No Ground To Disconnect Electricity Supply To Lawful Occupant By Decree Holder
Electricity being a basic necessity, its supply to a consumer in lawful possession cannot be discontinued merely because civil litigation concerning the property is pending. Disconnection is impermissible unless a court order expressly restrains supply. A decree holder seeking possession must execute the decree through lawful legal process and cannot resort to indirect means such as getting power supply disconnected to coerce vacation of premises.
