Electricity Dues -- Recovery of MCGC Beyond Two Years -- Not recoverable unless shown continuously as arrear
Electricity Act, 2003, S.56(2) -- Electricity Dues -- Recovery of MCGC Beyond Two Years -- Recovery of any sum due from a consumer after two years from the date it first became due is barred unless the amount is shown continuously as a recoverable arrear in bills issued to the consumer. Mere non-payment does not extend the limitation. A demand raised for the first time long after the period of consumption, without continuous treatment as arrear, is barred by limitation and cannot be enforced against the consumer.
