Domestic Violence -- Maintenance -- Relationship in Nature of Marriage Sufficient to Claim Maintenance Under Domestic Violence Act
Protection and maintenance under the Protection of Women from Domestic Violence Act, 2005 are available to a woman even without legal proof of a valid marriage, provided a relationship in the nature of marriage is established. The definition of "domestic relationship" under Section 2(f) of the DV Act is broad enough to cover cohabitation falling short of a legally valid marriage. A man who enjoys the benefits of a de facto marriage cannot escape maintenance liability by exploiting the absence of formal marriage documentation.
