Default Bail -- Non-Filing of Additional Copies of Charge-Sheet -- Not a ground for statutory bail
Bharatiya Nagarik Suraksha Sanhita, 2023, S.193(8) -- Default Bail -- Non-Filing of Additional Copies of Charge-Sheet -- Non-compliance with the requirement to file additional copies of the charge-sheet does not vitiate the charge-sheet or police report. The right to default bail arises only when the charge-sheet is not filed within sixty or ninety days as applicable, and stands extinguished once the charge-sheet in proper form is filed within that period. Such non-compliance cannot be treated on par with failure to file the charge-sheet itself.
