Compromise Decree -- Confined to Suit Property, Registration Under Section 17 -- Registration not required, non-registration does not render decree void
(i) Registration Act, 1908, S.17(2)(vi) -- Registration of Compromise Decree -- Decree Confined to Suit Property -- Where the property mentioned in a compromise decree is nothing but the suit property, and the decree does not take within its fold any property other than the suit property, such compromise decree need not be registered. (ii) Registration Act, 1908, S.17 -- Registration of Compromise Decree -- Effect of Non-Registration -- Non-registration of a compromise decree does not render it null and void. (iii) Civil Procedure Code, 1908, O.23 R.3 -- Compromise Decree -- Requirement of Reducing Terms to Writing -- Where a compromise is to be recorded and a decree passed in terms thereof, Order 23 Rule 3 CPC requires that the terms of compromise be reduced into writing and signed by both parties to the suit. (iv) Specific Relief Act, 1963, S.37 -- Suit for Injunction -- Person Against Whom Suit Maintainable -- A person may file a suit for injunction against a person who interferes with his possession, and not against any other person who does not so interfere.
