Compassionate Appointment -- Succession Certificate Cannot Be Demanded Where Policy Establishes Wife's First Preferential Right Over Deceased Employee's Brother
Where the compassionate appointment policy expressly places the wife in first order of priority under Clause 2.1 and permits consideration of a brother only if the deceased government servant was unmarried under Clause 2.6, administrative authorities cannot insist on a succession certificate merely because the brother has also applied. Such demand is arbitrary and contrary to the policy's clear hierarchical structure. Clause 2.7 requiring succession certificate applies only when neither husband nor wife is alive.
