Arbitral Award -- Objection Petition Filed Beyond Limitation -- Bar under Section 34(3) absolute and cannot be condoned
(i) Arbitration and Conciliation Act, 1996, S.34(3) -- Arbitral Award -- Objection Petition Filed Beyond Limitation -- The expression "but not thereafter" places an absolute embargo on condonation of delay beyond the extended period of thirty days. Limitation commences from the date the party acquires knowledge of the award, including through acknowledgement on an electronic messaging platform, and does not require delivery of a physically signed copy where such knowledge and subsequent conduct are established. (ii) Arbitration and Conciliation Act, 1996, S.34 -- Arbitral Award -- Acquiescence and Conduct of Party -- A party who acknowledges an award and engages in bilateral discussions on its implementation, including execution of transfer documents, cannot later raise technical objections to the award. The doctrine of approbate and reprobate applies, and such objections raised after prolonged inaction and enjoyment of benefits under the award are treated as an afterthought to obstruct execution.
