Amendment of plaint -- Partition suit -- Inclusion of additional properties
In a partition suit, a plaintiff may not be aware of all the common ancestral properties at the time of filing the suit -- Where during the pendency of the case the plaintiff acquires knowledge of additional properties that ought to be included in the partition, an amendment sought to add such properties cannot be refused on mere technical grounds--CPC, 1908, O.6 R.17.
