Agreement to Sell -- Specific Performance -- Ready and Willing -- Continuous Readiness Throughout Relevant Period
A plaintiff seeking the relief of specific performance of an agreement to sell is required to establish that he was ready and willing to perform his part of the contract not merely at the time of filing the suit, but continuously throughout the entire relevant period from the date of the agreement up to the date of the decree. A mere assertion of readiness at the time of institution of the suit is insufficient to entitle the plaintiff to the relief of specific performance -- Specific Relief Act, 1963
