Adoption of Child--Illegal Adoption--Custody Cannot Be Restored Where Child Procured Through Process Not Recognised Under Juvenile Justice Act, 2015: Emotional Bond Cannot Regularise Illegal Adoption or Override Prohibition Under Section 81 JJ Act

Custody of a child cannot be restored to adoptive parents where the child was procured through a process not recognised under the Juvenile Justice (Care and Protection of Children) Act, 2015, and CARA guidelines. Section 81 of the JJ Act expressly prohibits sale or procurement of children for any purpose. Emotional bonding between the child and adoptive parents cannot legitimise an illegal adoption or serve as a ground to regularise it, as such relief would encourage child trafficking and undermine statutory safeguards.
