Accident--Income--Documentary Proof of Income Not a Prerequisite for Just Compensation in Motor Accident Claims--Compensation Enhanced Eight-Fold

Absence of documentary proof of income is not a valid ground to deny just compensation to an injured claimant in motor accident proceedings. Motor Accident Claims Tribunal proceedings are summary in nature and do not require evidence in stricto sensu. Compensation for loss of income and earning capacity must be assessed on a reasonable basis, considering the nature of injuries, period of treatment, and prevailing conditions. Functional disability relevant to the nature of occupation of a claimant may differ from medically certified permanent disability for the purpose of computing future loss of income.
