Unlawful Assembly -- Common Object of Unlawful Assembly Sufficient for Conviction -- Individual Overt Acts Need Not Be Proved
Under Section 149 of the IPC, every member of an unlawful assembly is vicariously liable for acts committed by any member in furtherance of the common object. Absence of a specific eyewitness account attributing individual overt acts to each accused is not fatal to conviction. Proof of membership of an unlawful assembly and existence of a common object is sufficient to fasten liability, without requiring direct attribution of the act of killing to each accused individually.
