UAPA--Terrorist Act--Participation in Seminar on Islamic Literature Without Prima Facie Material of Conspiracy Does Not Satisfy Essential Ingredients of Terrorist Act Under Section 15 of UAPA to Deny Bail

Mere participation in a seminar on Islamic literature does not constitute an offence under the bail-restricting provisions of the Unlawful Activities (Prevention) Act, 1967 (UAPA). Possession of literature, even if it propagates violence, does not by itself amount to a terrorist act under Section 15 of UAPA, nor do allegations of ideological inclination, without concrete proof of unlawful acts or conspiracy, meet the threshold required to deny bail. Unverified documents, photocopies, or unsigned materials are insufficient to establish prima facie guilt under the stringent bail provisions of UAPA. Essential ingredients of a terrorist act under Section 15 must be satisfied before bail is refused.
