Kidnapping--Threat Of Suicide -- To Compel Victim To Accompany Accused Amounts To Enticement Under Section 363 IPC
A threat by an accused to commit suicide unless the victim accompanies him constitutes "enticement" within the meaning of Section 363 of the Indian Penal Code. To establish kidnapping, it is not necessary to prove forcible removal from the custody of a lawful guardian. It is sufficient to show that the victim was "caused to go" by influence created in her mind by the accused, resulting in her leaving the custody of her lawful guardian without consent.
