Surrogacy -- Age Restriction on Intending Couple -- Rigid application infringes reproductive autonomy under Article 21
Surrogacy (Regulation) Act, 2021, S.4(iii)(v)(c)(I) -- Surrogacy -- Age Restriction on Intending Couple -- Rigid application infringes reproductive autonomy under Article 21. Age restriction under the provision does not apply where the intending couple initiated the surrogacy procedure prior to enforcement of the Act. Reproductive autonomy is part of personal liberty under Article 21, and rigid application of the age limit to such couples violates this right.
