Special Marriage Act--Indian and Foreigner Marriage--NOC from Embassy Cannot Be Insisted Upon as Precondition for Solemnization

There is no prohibition under the Special Marriage Act, 1954 against solemnization of marriage between an Indian citizen and a foreign national. A Sub-Registrar or Marriage Officer cannot insist on production of a No Objection Certificate from the Embassy of the foreign national as a precondition for processing or solemnizing such marriage. Submission of notice of intended marriage and a notarized affidavit is sufficient compliance with the statutory requirements.
