FIR--Second FIR--Larger Conspiracy--Registration Permissible Where Subsequent Audit Uncovers Fresh Involvement Not Disclosed in Earlier FIR
Registration of a second FIR is permissible where it presents a rival or counter version of facts arising from the same circumstances as the first FIR, provided it relates to a larger conspiracy or where investigation subsequently uncovers hitherto unknown facts. The bar against second FIR does not apply where the earlier FIR was filed by a person who later becomes the accused in a subsequent FIR. In such a case, the subsequent FIR is the first FIR against that person, and resort to further investigation under Section 173(8) CrPC is not mandatory.
