SCST--FIR Based on Police Statement Equally Valid--Source of Information ImmaterialOnce Cognizable Offence Disclosed

Registration of an FIR on the statement of a police official who witnessed the incident is valid and its authenticity cannot be doubted merely because no complaint was filed by the victim. Under the SC/ST (Prevention of Atrocities) Act, 1989, the source of information triggering registration of an FIR is immaterial once the information discloses commission of a cognizable offence. Courts considering anticipatory bail must examine whether allegations disclose cognizable offences, and cannot ignore investigation reports and police affidavits forming part of the record.
