SCST -- Casteist Remarks-- Referring to a Person by Profession Does Not Constitute Offence Under SCST Act In The Absence Of Intention to Humiliate

Use of words referring to profession does not by itself attract offences under Sections 3(1)(Da) and 3(1)(Dha) of the SSCST Act-- Intentional insult must be with specific intent to humiliate a person on account of membership of SC/ST community. Conversion of a protest petition into a complaint implies non-acceptance of the final report under Section 173(2) of the Code of Criminal Procedure, and a specific recital of disagreement is not mandatory.
