Rash & Negligent Driving-- Overtaking Across Central Line Is Rash Driving-- Trial Court Cannot Ignore Road Regulations While Assessing Negligence

Crossing the central line while overtaking constitutes rash and negligent driving under Sections 279, 337, and 338 of the IPC, read with Rule 6 of the Rules of Road Regulations, 1989, which prohibits overtaking likely to endanger oncoming traffic. Appellate interference in acquittals is justified where the trial court misreads material evidence or reaches a conclusion no reasonable person could reach. Testimony of related witnesses cannot be discarded solely on grounds of relationship if otherwise credible and consistent.
