Under Section 69 of the Bharatiya Nyaya Sanhita, 2023, sexual intercourse obtained through deceitful means or a false promise of marriage is a distinct punishable offence, separate from rape. Where an accused is already married at the time of making a promise of marriage, the promise is deceitful from its very inception, as he knew it could never be fulfilled.
