Declaration of an accused as absconder under Sections 82 and 83 CrPC cannot be resorted to without exhausting all reasonable and efficacious steps to secure the presence of the accused. The power to declare an accused absconding is not merely administrative but carries serious legal consequences. Its invocation must be preceded by demonstrable adherence to procedural safeguards under the Code. Mere irregularity in appearance and breach of bail conditions, without prior exhaustion of such steps, does not justify recourse to this extreme measure.
