POCSO--Penetrative Sexual Assault--Hymen Rupture Not Required; Penetration to Any Extent Sufficient Under Section 3(a)

Rupture of the hymen is not necessary to establish the offence of penetrative sexual assault under Section 3(a) of the Protection of Children from Sexual Offences Act. Penetration to any extent is sufficient to constitute the offence. Scientific and forensic evidence is corroborative in nature and its deficiency does not undermine a credible and trustworthy testimony of the child victim. Sentence must conform to the statutory provision as it stood at the time of commission of the offence.
