POCSO -- Compensation--It Cannot Be Denied for Absence of Physical Injury

Compensation under the 'Uttar Pradesh Rani Lakshmi Bai Mahila Samman Kosh Rules, 2015' cannot be denied to a victim of penetrative sexual assault under Section 4 of the POCSO Act merely because the medical report does not show evidence of "penetrating injury." --Interpreting Section 3 of the POCSO Act, the Court held that penetrative sexual assault does not necessarily result in visible physical injury, and the Scheme compensates victims for having suffered the assault itself, not for physical injuries sustained -- Steering Committee cannot assume the role of a trial court and must grant compensation upon filing of FIR, injury report, and charge sheet.
