NDPS--Substances Absent From NDPS Schedule--Phenothiazine and Promethazine Governed by Drugs and Cosmetics Act, 1940; Conviction Under NDPS Act Prima Facie Unsustainable
Phenothiazine and Promethazine do not fall within the definition of "narcotic drug" under Section 2(xiv) or "psychotropic substance" under Section 2(xxiii) of the NDPS Act, 1985. Neither substance appears in the Schedule of psychotropic substances appended to the NDPS Act nor in Schedule I of the NDPS Rules, 1985. Both substances are governed by the Drugs and Cosmetics Act, 1940, appearing under Schedules H and G respectively of the Drugs Rules, 1945.
