NDPS--Drug Money--Single Uncorroborated Transaction of ₹15,000 Cannot Establish NDPS Complicity; Section 37 Rigour Not Attracted
A solitary monetary transaction between a co-accused and an accused, without supporting evidence of complicity, cannot establish involvement in an offence under the NDPS Act, 1985. The stringent bail conditions under Section 37 of the NDPS Act are not attracted in the absence of substantive linking material. Confessional statements under Section 67 of the NDPS Act remain inadmissible. For foreign nationals, informing the FRRO and facilitating embassy communication constitutes sufficient compliance under Article 22 of the Constitution. Bail granted by a criminal court does not override powers of detention under the Foreigners Act, 1946.
