Murder-- Corpus Delicti -- Failure To Recover Dead Body Does Not Entitle Accused To Benefit Of Doubt When Cumulative Weight Of Circumstances Points Unerringly To Guilt

Non-recovery of the dead body does not, as an invariable rule, render a prosecution case doubtful or entitle the accused to acquittal. In cases resting on circumstantial evidence, the last seen theory coupled with recovery of personal belongings of the deceased at the instance of the accused can constitute a complete and unbroken chain of circumstances establishing guilt. Each circumstance in the chain need not independently prove guilt; their cumulative weight must point unerringly to the hypothesis of guilt of the accused and exclude every other hypothesis.
