Motor Accident--Gratuitous Passenger--Insurer Cannot Be Exonerated from Liability and Must Pay Compensation with Right to Recover from Owner of Goods Vehicle
An insurance company cannot be exonerated from liability to pay compensation in motor accident claims merely because the injured person was a gratuitous passenger on a goods vehicle. The insurer is liable to pay the awarded compensation and may thereafter recover the amount from the owner of the vehicle. Violation of permit conditions or policy conditions relating to carriage of passengers does not absolve the insurer of the primary obligation to pay compensation to the claimant.
