Maintenance to Wife -- Wife Employed and Earning -- Wife is not entitled to interim maintenance for the period during which she was employed and earning
(i) Hindu Marriage Act, 1955, S.24 -- Maintenance to Wife -- Wife Employed and Earning -- A wife who is employed and earning at the time of filing an application for interim maintenance, and continues to remain employed, is not entitled to interim maintenance under Section 24 for that period. Entitlement to such maintenance arises only from the date she becomes unemployed. (ii) Hindu Marriage Act, 1955, S.24 -- Maintenance to Wife -- Assessment of Husband's Income -- A salary certificate issued by a relative employer, unsupported by other cogent documentary evidence, cannot conclusively establish the income of the husband. Where the husband fails to produce credible evidence of lower income-earning capacity, income assessed on the basis of the applicable minimum-wage notification does not warrant interference.
