Maintenance to Wife--Section 94 BNSS--Husband Entitled to Seek Production of Wife's Employment Records From Private Institution Upon Non-Disclosure of Income

Under Section 94 BNSS, a husband in maintenance proceedings may seek production of employment and income records of the wife from a private institution where she is employed, if such information is not disclosed by her. Both parties are under a mandatory obligation to make full and frank disclosure of income, assets, and liabilities in maintenance proceedings, and either party may seek production of relevant documents from the other. Where a private institution declines to furnish such information voluntarily, Section 94 BNSS is clearly attracted. The trial court cannot reject such an application on the ground that the burden of producing documents lies on the applicant.
