Maintenance to Wife -- Mother-in-Law Not Liable -- No obligation to maintain widowed daughter-in-law or her children

(i) Criminal Procedure Code, 1973, S.125(1) -- Maintenance to Wife -- Mother-in-Law Not Liable -- Section names both who may claim and who must pay maintenance -- It places no duty on a mother-in-law to maintain widowed daughter-in-law or children of deceased son -- Beneficial aim of the Section cannot add new classes of liable persons -- Means of the mother-in-law or assets of the deceased in her hands cannot create the liability. (ii) Criminal Procedure Code, 1973, S.125(1) -- Maintenance to Wife -- Remedy Against In-Laws Under Other Laws -- Conditional remedy of widowed daughter-in-law against father-in-law under Section 19 of Hindu Adoptions and Maintenance Act, 1956, cannot be read into Section 125 -- Death of father-in-law does not shift liability to his wife -- Pendency of domestic violence proceedings does not widen the classes liable under Section 125.
