Maintenance to Wife--Earning Capacity of Wife Does Not Extinguish Husband's Primary Obligation to Maintain Her
The mere fact that a wife is earning, or is highly qualified, is not a valid ground to deny maintenance. The duty of a husband to maintain his wife is a social and legal obligation, and the wife is entitled to the same standard of living enjoyed during cohabitation. Under Section 127 of the CrPC, enhancement of maintenance is permissible upon change in circumstances, including a substantial increase in the income of the husband.
