Maintenance to Child--Father Cannot Escape Maintenance Obligation Merely Because Custodial Mother Is Earning--Expenses Of Child Cannot Be Divided Equally

A husband cannot be absolved of his obligation to maintain his minor child merely because the wife is earning. Where the mother has custody, her contribution of time, effort, and emotional support in raising the child cannot be measured in monetary terms, and expenses of the child cannot be divided equally between parents. Maintenance under Section 125 CrPC encompasses not merely sustenance but also educational expenses, holistic development, and preservation of the child's dignity consistent with the status of parents. Maintenance must be determined contextually and not by rigid arithmetical standards.
