Maintenance to Child--Attainment of Majority During Pendency of Maintenance Proceedings Does Not Defeat Minor Daughter's Entitlement Under Section 125 CrPC
Under Section 125 CrPC, a minor daughter who files or is included in a maintenance application during minority cannot be denied maintenance solely on the ground that she attained majority during pendency of proceedings. The right to maintenance crystallises at the time of filing of the application. A father's obligation to provide for standard education of a daughter is a relevant consideration in determining quantum of maintenance. A wife earning a sufficient independent income is not entitled to maintenance under Section 125 CrPC.
