Maintenance -- Enhancement Without Adequate Reasoning Is Arbitrary -- Income of Husband is Relevant Factorflation Alone Cannot Justify
Enhancement of maintenance under Section 127 of the Criminal Procedure Code, 1973 must be grounded in adequate reasons. Inflation and changed circumstances justify enhancement, but the amount must not exceed a fair proportion of the income of the husband or encourage idleness. Doubling maintenance without palpable justification constitutes an arbitrary exercise of discretion amenable to revisional correction.
