Maintenance--Domestic Violence Act--Suppression of Financial Information Entitles Court to Draw Adverse Inference and Impute Earning Capacity of Husband
A husband cannot evade maintenance obligation by suppressing financial information. Where an able-bodied husband withholds material details about income and assets, the court is entitled to draw an adverse inference and impute a baseline earning capacity. This principle, affirmed in Tasmeer Qureshi v. Asfia Muzaffar (2025), applies under the Protection of Women from Domestic Violence Act. Discrepancies in income tax returns, unexplained bank accounts, and undisclosed business activities are sufficient grounds to assess income beyond the figure claimed by the husband.
