IPC, S.498A -- Cruelty to Wife -- Non-Communication for Thirteen Days

It cannot be said that a husband\'s refusal to speak to his wife for thirteen days amounts to cruelty within the meaning of Section 498A of the Indian Penal Code. It is a well-settled principle that what constitutes mental cruelty depends on the facts and circumstances of each case — there is no fixed rule. Differences between spouses are a normal part of married life, and a period of non-communication, without more, does not cross the threshold of cruelty. Mere oral testimony and absence of WhatsApp messages are not sufficient to prove lack of communication.
