Immoral Traffic -- Closure Of Premises Suspected To Be Used As Brothel Is A Quick-Acting Preventive Measure Under PITA -- Prior Conviction Of Owner Not Required

Closure of premises under Section 18(1) of the Immoral Traffic (Prevention) Act, 1956 is a preventive measure and does not require prior conviction of the owner or occupier under Sections 3 or 7 of the Act. Section 18(1) confers power on the Magistrate as a quick-acting preventive mechanism, distinct from Section 18(2), which operates post-conviction and is exercisable by the convicting court. These two powers are exercised by different authorities in different contingencies. Failure to respond to show-cause notices disentitles a party from raising violation of natural justice before the High Court.
