Identification of Accused-- Dock Identification Without Test Identification Parade -- Not fatal in every case

Evidence Act, 1872 S.8 -- Identification of Accused -- First Time in Court--It is not fatal to the prosecution's case if no Test Identification Parade was held, provided the witness had a sufficient opportunity to observe the distinctive features of the accused at the time of the incident, or the accused was arrested on the spot immediately after the crime. It is a well-settled position of law that dock identification in court for the first time cannot be discarded on this ground alone where the circumstances lend assurance to the witness's testimony.
