House Trespassing--Existence of Matrimonial Litigation Does Not Permit Forcible Entry Into House and Assault on Occupants

Pendency of matrimonial litigation does not grant license to forcibly enter a house without permission and assault the occupants. Even if the incident occurred in the presence of police officials, the accused have no right to enter premises and assault the complainant. Power of quashing under Section 482 CrPC must be exercised sparingly with circumspection and only in the rarest of rare cases. The Court cannot enquire into reliability or genuineness of allegations at the initial stage.
