Forgery--Fake Court Order--FIR Against Lawyer Accused of Fabricating Judicial Orders

An application under Section 156(3) of the Code of Criminal Procedure lies before a Magistrate where police fails to act on a cognizable complaint. Fabrication of court decrees and forgery of signatures to defraud clients constitutes a cognizable offence warranting police investigation. A finding of gross misconduct by the Bar Council of Delhi, resulting in suspension of licence of an advocate, may support prima facie satisfaction of a Magistrate while directing registration of an FIR.
