FIR--Second FIR on Same Incident with Identical Allegations Quashed -- Suppression of Earlier FIR and Non-Compliance with Sections 154(1), 154(3) CrPC Before Invoking Section 156(3) Renders Prosecution Unsustainable
Where a second criminal proceeding is instituted concerning the same incident with substantially identical allegations, without disclosing existence of an earlier FIR, and mandatory requirements under Sections 154(1) and 154(3) CrPC are not complied with before invoking Section 156(3) CrPC, continuation of such prosecution constitutes abuse of process of law. Omnibus allegations against family members, unsupported by specific overt acts or corroborative material, cannot sustain criminal trial under Sections 498A/307 IPC.
