Examination of Accused-- Admission Under Section 313 CrPC Can be Used Against Accused to Sustain Conviction

Statements made by an accused under Section 313 of CrPC, though not evidence on oath, can be used to support a conviction where they corroborate the prosecution's case. Once execution and signature of a cheque are admitted, the presumption under Section 139 of the Negotiable Instruments Act arises, shifting the burden of proof to the accused.
