Dowry Prohibition--Dowry Giver--On basis of complaint for taking of dowry, the wife and her family cannot be prosecuted for dowry giving.
Under Section 7(3) of the Dowry Prohibition Act, 1961, a person aggrieved by a dowry offence cannot be prosecuted under the Act solely on the basis of statements or complaints made by them against dowry takers. Admissions of giving dowry, made in the course of a complaint against demand or taking of dowry, are statutorily protected and cannot form the substratum for launching prosecution under Section 3 of the Act. However, this protection does not apply where independent evidence, beyond such complaints or statements, establishes the offence of giving dowry.
