Statutory presumption under Section 113B of the Indian Evidence Act in a dowry death case under Section 304B of the IPC is triggered only after the prosecution strictly proves that the deceased was subjected to cruelty or harassment in connection with a dowry demand "soon before death." Unnatural death within seven years of marriage alone is insufficient to invoke the presumption. All foundational ingredients of the offence must be established beyond reasonable doubt before the burden shifts to the accused.
