Dowry Death--General Harassment Allegations Without Specific Cruelty Soon Before Death in Dowry Death Case--Quashed

For conviction under Section 304B IPC, prosecution must prove cruelty or harassment in connection with dowry demand inflicted soon before death. General allegations of harassment without specific instances attributable to accused, particularly when accused was absent at time of death, are insufficient. Mere establishment of dowry demand is insufficient; prosecution must prove proximate causal cruelty. Acquittal under Section 304B IPC renders dependent conviction under Section 316 IPC unsustainable.
